Buying Property in Panama as a Foreigner: Rules, Taxes, and What to Know
Buying property in Panama as a foreigner can be remarkably straight forward. Panama offers one of the most foreigner-friendly real estate environments in Latin America. Whether you’re looking for a second home, a rental investment, or a path to residency, owning property in Panama is a smart move in 2025.
This guide walks you through the legal rights, property tax system, closing process, and how to avoid common pitfalls — all while protecting your investment.
Can Foreigners Buy Property in Panama?
Yes. 100% foreign ownership is legal in Panama.
Unlike some other Central American countries that place restrictions on property ownership for foreigners, Panama grants equal property rights to foreigners and citizens — including the ability to:
-
- Own land in your own name
- Own titled beachfront property
- Register property through a corporation or foundation
- Use your property as a path to Panama residency
Exceptions:
The only notable restriction is within 10 km of international borders, where foreigners cannot purchase land for national security reasons. This affects parts of Chiriqui, Bocas del Toro, and the Darién region.
Types of Property You Can Buy
1. Titled Property
Most recommended. This means your ownership is officially registered in the Public Registry of Panama, similar to deeds in the U.S. or Canada. It provides full legal protection. This is the gold standard of property ownership.
2. Right of Possession (ROP)
This is not titled property, and is typically found in rural or coastal zones. It’s riskier and often lacks the legal certainty of titled property. In general, we do not recommend ROP purchases for foreign buyers.
Pro Tip:
Only work with licensed brokers and attorneys when purchasing real estate in Panama. Contact Panama Sovereign Realty for vetted listings.
How the Buying Process Works
Buying property in Panama is simple when done correctly.
Here’s the process:
- Offer & Acceptance
Submit a written offer. Include amount offered, timelines, conditions, and deposit terms. - Due Diligence
A real estate attorney will verify:
– Title status: confirm that the property is free of liens or encumbrances.
– Proper ownership: confirm the owner is who they say they are.
– Surveyed boundaries: confirm the property is what the owner says it is.
– Zoning and construction permissions: confirm you can use the property as you intend to. - Sales Agreement & Deposit
A formal promise to purchase agreement is signed and a 10% – 20% non-refundable deposit is usually paid to the seller. - Final Closing
Buyer and seller sign the transfer deed or shares transfer documents. The final balance is paid and the buyer’s attorney submits the documents for registration at the Public Registry (Registro Público).
Do You Need to Be in Panama to Buy Property?
No, you can buy remotely.
With a power of attorney, your attorney can handle:
- Contract signing
- Title registration
- Bank transactions
However, we strongly recommended to visit in person before deciding on a property purchase.
Panama Property Taxes Explained
Panama offers one of the most tax-friendly environments for property owners. It is the seller who typically pays the transfer and gains taxes on a property sale in Panama.
Property Transfer Tax
- Charged on the transfer of a property title
- 2% of the property’s registered or transfer value, whichever is higher
Capital Gains Tax
- Also charged on the transfer of of a property title
- Sellers have the option to pay either 10% of the net gain or 3% advanced payment on total sale price
Shares Transfer Tax
- 5% of the transfer value charged on the transfer of corporate shares
- This amount is typically withheld from the final payment and paid by the buyer
Annual Property Tax
- 0.0% – 0.8% depending on property value
- Primary residences under $120,000 are exempt
- Some older construction still has long term exonerations in place, in some cases until 2039
Your attorney will calculate the actual obligations at closing.
Foreign Buyer Financing Options
Foreign buyers typically pay in cash (via bank transfer) as access to financing in Panama can be limited:
- Developer Financing: Common for pre-construction. 20–30% down, short-term loans.
- Panamanian Banks: Harder to obtain without residency or local income.
- Home Country Loans: Possible through personal loans or home equity lines of credit (HELOC).

Should You Use a Corporation or Buy Personally?

- In your personal name
- Through a Panamanian corporation or foundation
Why use a corporation or private interest foundation?
- Improved asset protection

This is highly case-dependent. A qualified lawyer can advise you.
Common Mistakes Foreign Buyers Should Avoid
- Buying without a lawyer
Never rely on the seller’s or agent’s legal advice. - Not verifying the title
Always confirm the property is free from liens, disputes, or overlapping claims. - Buying ROP land without understanding risks
ROP carries far more risk than buying titled property. - Sending money to individuals without an agreement signed by both parties
Always use verified legal accounts or law firm trust accounts. - Skipping the inspection
Even new builds should be inspected before handover.
